Acceptance
By accessing or using Fesera ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
About the App
Fesera is a documentation aid that allows physiotherapists to create evaluation and progress notes through customizable templates. Your sessions are stored in our cloud infrastructure to enable access across devices and reliability. Use only de-identified content in the App.
No Medical Advice; Not a Medical Device
Fesera is an assistive tool for organizing and formatting clinical documentation. It does not provide medical advice, diagnosis, or treatment and is not a medical device. You must exercise independent professional judgment and verify all outputs before using them in clinical records or care decisions. Do not use Fesera for emergencies.
Prohibited Content and PHI/PII
- Do not enter Protected Health Information (PHI) or personally identifiable information (PII) into the App. Use de-identified content only.
- Do not upload images, recordings, or text that include patient names, dates of birth, addresses, medical record numbers, facial images, or other identifiers.
- Do not use the App to create, store, or transmit sensitive personal data or confidential information of third parties.
Data Handling and Storage
- Notes, templates, and related session data are stored in our cloud infrastructure. We use industry-standard safeguards; however, no system is 100% secure.
- If you export or sync content to third-party services or systems (e.g., EMRs), you are solely responsible for lawful transfer, security, and compliance.
- You may request deletion of your account; we will delete cloud-stored session content after a reasonable processing period, subject to backup retention.
License & Restrictions
- We grant you a non-exclusive, non-transferable license to install and use the App for professional physiotherapy record-keeping.
- You may not reverse-engineer, redistribute, or offer the App as a service to third parties without prior written consent.
User Responsibilities
- You are solely responsible for the accuracy, legality, and retention of all patient data entered into the App.
- You must comply with applicable privacy, health-records, and professional-practice laws (e.g., HIPAA, GDPR, provincial/state health regulations).
- You must de-identify all inputs and confirm that generated content is appropriate before inclusion in official records.
Intellectual Property
All code, design, and content of the App are the property of Daniel Fesera Technologies or its licensors. All rights not expressly granted here are reserved.
Disclaimer & Limitation of Liability
- The App is provided "as-is" without warranties of any kind.
- We do not guarantee compliance with any specific regulatory standard.
- To the maximum extent permitted by law, Daniel Fesera Technologies shall not be liable for indirect or consequential damages arising from use of the App.
- No content generated by the App replaces professional decision-making or supervision.
Service Availability
We do not guarantee continuous, error-free operation. Features may change or be discontinued at any time.
Indemnification
You agree to indemnify and hold Daniel Fesera Technologies harmless from claims, liabilities, damages, and expenses arising from your use of the App, your violation of these Terms, or your violation of any law or third-party right.
Eligibility
The App is intended for use by trained healthcare professionals aged 18 and older.
Feedback
If you submit feedback or suggestions, you grant us a non-exclusive, royalty-free license to use them to improve the App without obligations to you.
Termination
We may discontinue or suspend your access if you breach these Terms. You may stop using the App at any time; account deletion requests will be processed within a reasonable period and active cloud copies will be removed, with backups purged thereafter.
Changes to Terms
We may update these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of Nigeria, without regard to conflicts of law principles.
