Terms of Service

Important notice — please read carefully. Fesera is a guided self-administered rehabilitation tool, not a medical service. It does not provide medical diagnosis, clinical treatment, or professional healthcare advice. By using Fesera, you acknowledge that you have read and understood this notice and the full terms below.

If you are experiencing a medical emergency, call your emergency services immediately. Do not use this platform in an emergency.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fesera Health Technologies ("Fesera," "we," "us," or "our"), governing your access to and use of the Fesera platform, including the website at fesera.com and the Fesera web application (collectively, the "Service").

By registering an account, accessing, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms in their entirety, you must not access or use the Service.

2. About Fesera

Fesera is a digital rehabilitation platform that delivers a guided, self-administered, evidence-based 12-week exercise and education programme designed for adults with chronic non-specific low back pain (CLBP). The programme is designed by licensed physiotherapists and grounded in published clinical research and validated clinical tools, including the STarT Back Screening Tool, McKenzie Method principles, and McGill Method principles.

Fesera classifies a user's pain pattern through a structured assessment and delivers a personalised programme based on that classification. The Service is intended to supplement, not replace, professional healthcare.

As Fesera grows, we may introduce programmes for other musculoskeletal (MSK) conditions, women's health-related conditions, and related areas of physical rehabilitation. Any future programmes will be subject to these Terms as updated from time to time.

3. Medical Disclaimer

3.1 Not a Medical Service

The Fesera platform and all its content — including assessments, exercise programmes, education modules, classifications, and progress tracking — are provided for informational, educational, and self-guided rehabilitation purposes only. Fesera is not a medical service, does not constitute the practice of medicine, and does not create a doctor-patient or physiotherapist-patient relationship between you and Fesera or any of its staff.

3.2 Not a Substitute for Professional Care

Nothing on the Fesera platform is intended to, nor should it be interpreted to, replace, substitute for, or supersede the advice, diagnosis, or treatment of a qualified healthcare professional. Always consult a physician, physiotherapist, or other qualified health professional before beginning any exercise programme, particularly if you have an existing health condition, injury, or concern.

3.3 Red Flag Conditions

Fesera includes a red flag screening tool at the start of the assessment. This tool is designed to help identify symptoms that may indicate a serious underlying medical condition that requires urgent professional evaluation. If you are flagged by this tool, you must seek professional medical assessment before using the programme. This screening is not diagnostic. Passing the screening does not guarantee the absence of serious pathology.

If you develop any of the following symptoms at any time — including during the programme — you must stop immediately and seek urgent medical attention:

  • Severe, worsening pain not relieved by rest
  • Unexplained weight loss
  • Fever or night sweats alongside back pain
  • Loss of bladder or bowel control
  • Significant leg weakness, numbness in the saddle or groin area (cauda equina symptoms)
  • History of cancer with new onset back pain
  • Back pain following significant trauma
  • Pain that is constant, severe, and not mechanical in nature

3.4 Programme Limitations

The Fesera programme is designed specifically for chronic non-specific low back pain lasting 12 or more weeks in adults, where serious pathology has been screened out. It is not intended for:

  • Acute low back pain (fewer than 12 weeks duration)
  • Back pain caused by fracture, infection, cancer, or inflammatory disease
  • Post-surgical rehabilitation without explicit clearance from your surgeon
  • Individuals with conditions that contraindicate exercise (e.g., unstable cardiovascular disease, severe osteoporosis)
  • Children or adolescents under 18

3.5 Exercise Risks

All exercise carries inherent risk. Fesera's programme is designed to be low-risk and progressive; however, it is your responsibility to listen to your body, follow the pain-response guidance provided, and stop or modify activity if you experience unexpected pain, dizziness, chest pain, shortness of breath, or any symptom that concerns you. Fesera is not liable for injury arising from use of the programme.

4. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have capacity to enter into a binding legal agreement
  • Not have been previously banned from the Service
  • Provide accurate, complete, and truthful information during registration and assessment
  • Access the Service from a jurisdiction where doing so is lawful

By using the Service, you represent and warrant that you meet all eligibility criteria. Fesera reserves the right to suspend or terminate accounts that do not meet these requirements.

5. Account Registration and Security

5.1 Account Creation

To access the full Service, you must register an account using a valid email address and a secure password. You agree to provide accurate, current, and complete information and to update it promptly if it changes.

5.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account with any other person. You agree to notify Fesera immediately at support@fesera.com if you become aware of any unauthorised use of your account.

5.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts, including to circumvent a suspension or paywall, is prohibited.

6. The Fesera Programme

6.1 Free Assessment

The initial assessment — including the red flag screening, pain profiling, and back pain subtype classification — is provided free of charge to all registered users. Completing the assessment does not obligate you to purchase the full programme.

6.2 Paid Programme Access

Access to the full 12-week rehabilitation programme, including all exercise sessions, education modules, phase progressions, and progress tracking tools, requires a one-time payment as described in Section 7. Once payment is confirmed, access to the full programme is granted and remains available to your account for the duration of the Service.

6.3 Programme Structure

The 12-week programme is divided into phases: a Foundation phase, a Loading phase, and a Functional Strength phase, followed by a Maintenance phase. Progression through phases is governed by clinical readiness criteria built into the programme. Fesera makes no guarantee that any user will complete all phases or achieve a specific clinical outcome.

6.4 Personalisation

The programme is personalised based on the answers you provide during the assessment. The accuracy and appropriateness of the programme depend on the accuracy of the information you provide. Providing false or inaccurate information may result in a programme that is inappropriate for your condition.

6.5 Adherence and Outcomes

Clinical outcomes from exercise-based rehabilitation are strongly dependent on consistent adherence to the programme. Fesera does not guarantee any specific outcome, including pain reduction, improved function, or return to activity. Published research on structured exercise programmes for chronic low back pain shows broadly positive outcomes at a population level; individual results vary significantly.

6.6 Programme Updates

Fesera may update programme content, educational materials, and exercise libraries from time to time to reflect evolving clinical evidence. We will communicate material changes to users in advance where reasonably practicable.

7. Payment and Billing

7.1 Pricing Model

Fesera currently offers the programme as a one-time purchase. We reserve the right to introduce alternative pricing models in the future — including subscription plans, tiered access levels, or bundled programme packages — as the Service evolves. Any such changes will be communicated clearly and will not affect the terms of access already paid for.

The current purchase price is displayed at the point of checkout and is final for that transaction. Access to the paid programme is granted upon confirmed payment and remains tied to your account for as long as the Service is operational and your account is in good standing.

7.2 Regional Pricing

Fesera may offer different pricing in different countries or regions to reflect local purchasing power, currency, and market conditions. The price shown to you at checkout is the price applicable to your region at the time of purchase. Regional pricing does not affect the content or quality of the programme; all users access the same programme regardless of the price paid in their region.

Fesera reserves the right to adjust regional prices at any time. Price changes for new purchases do not alter the terms of any already-completed transaction.

7.3 Currencies and Payment Processing

Payments are processed in the currency displayed at checkout, which may be Nigerian Naira (NGN) or another local or international currency depending on your region. All payments are processed securely through Paystack or other payment providers we may introduce in future markets. By completing a payment, you agree to the relevant payment provider's own terms and privacy policy.

Fesera does not store your card number, CVV, expiry date, or bank account details. Only transaction references and status are retained.

7.4 Future Subscription Model

Fesera may in the future offer subscription-based access to new or expanded programmes. Where a subscription is introduced:

  • Subscription pricing, billing intervals, and cancellation terms will be clearly disclosed before any charge
  • You will never be automatically enrolled in a subscription without actively selecting it
  • Subscription fees are billed in advance for the selected period and are non-refundable for the billing period already begun, except as described in Section 7.5

Existing one-time programme purchasers will not be converted to or charged under any subscription model. Your one-time access remains valid under the terms at the time of purchase.

7.5 Refund Policy

7.5.1 Cooling-Off Period

You may request a full refund within 14 days of your purchase date, provided that you have not yet accessed more than 14 days of programme sessions. This cooling-off period acknowledges that some users may purchase and then decide the programme is not right for them before meaningfully engaging with it.

To request a refund, contact support@fesera.com with the subject line "Refund Request" and include your registered email address and the reason for the request. We aim to process approved refunds within 10 business days.

7.5.2 After the Cooling-Off Period

After 14 days, or once you have accessed more than 14 days of programme content, payments are non-refundable. This is because the core programme content has been made available to you and the costs of programme delivery have been incurred.

7.5.3 Technical Failures

If a technical failure on our part prevents you from accessing the programme after payment, please contact support@fesera.com within 14 days. We will investigate and, where the failure is confirmed on our side, provide either corrected account access or a full refund.

7.5.4 "It Didn't Work" or "Not What I Expected"

Fesera does not offer refunds on the basis that the programme did not produce the health outcome a user hoped for, or because the programme was not what the user expected based on a reasonable reading of the information provided before purchase. Exercise-based rehabilitation depends heavily on individual adherence, biology, and circumstances that Fesera cannot control, and no clinical outcome guarantees are made.

Where a user believes the programme was materially misrepresented, they may contact support@fesera.com. Such cases are reviewed individually, and Fesera retains full discretion over any goodwill remedy offered.

7.5.5 Statutory Rights

Nothing in this Section 7.5 limits any statutory refund or consumer protection rights you may have under the laws of your country of residence that cannot be excluded by contract.

7.6 Payment Failures

If a payment attempt fails, your access to the paid programme will not be granted. Fesera is not responsible for payment failures caused by your bank, card issuer, internet connectivity, or the payment processor's systems.

7.7 Receipt and Records

A payment confirmation will be sent to your registered email address upon successful payment. You should retain this for your records. VAT or other tax receipts will be provided where required by local law.

8. User Conduct and Obligations

By using the Service, you agree that you will:

  • Use the Service only for its intended purpose — your own personal rehabilitation
  • Provide truthful and accurate information in all assessments and check-ins
  • Follow the programme as described and notify us if you experience unexpected adverse symptoms
  • Not use the Service for any unlawful or unauthorised purpose
  • Not attempt to reverse-engineer, scrape, copy, or reproduce any part of the programme, content, or assessment logic
  • Not share your account credentials with others or allow third parties to use your account
  • Not attempt to circumvent security measures, payment systems, or access controls
  • Not use the platform to provide clinical advice to other people
  • Not submit false, misleading, or abusive information
  • Comply with all applicable laws and regulations

9. Intellectual Property

9.1 Ownership

All content on the Fesera platform — including but not limited to the assessment framework, programme design, exercise protocols, education modules, graphics, UI design, code, and text — is owned by Fesera Health Technologies or its licensors and is protected by applicable intellectual property laws.

9.2 Licence to Use

Fesera grants you a limited, non-exclusive, non-transferable, revocable personal licence to access and use the Service for your own personal rehabilitation. This licence does not permit you to copy, distribute, reproduce, publish, sublicense, or create derivative works from any part of the Service.

9.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Fesera a non-exclusive, royalty-free, perpetual, irrevocable licence to use and incorporate that feedback into the Service without obligation to you.

10. Privacy and Data

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, store, share, and protect your personal and health data, including our intentions to use anonymised, aggregated data for research purposes. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Third-Party Services

The Service integrates with or relies on third-party services including Paystack (payment processing) and Supabase (data infrastructure). Your use of these third-party services is subject to their own terms and privacy policies. Fesera is not responsible for the practices of these third parties beyond our contractual obligations with them.

12. Service Availability and Modifications

12.1 Availability

Fesera makes reasonable efforts to maintain service availability but does not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

12.2 Modifications

Fesera reserves the right to modify, suspend, or discontinue any aspect of the Service at any time. In the event of a material discontinuation that affects paid programme access, Fesera will provide reasonable notice and consider appropriate remedies.

13. Disclaimers

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  • Fesera does not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components.
  • Fesera does not warrant that the programme will achieve any particular clinical or health outcome for any individual user.
  • Fesera expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fesera, its directors, employees, contractors, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the Service, including but not limited to loss of data, personal injury, health complications, or loss of profits.

Fesera's total cumulative liability to you for any claims arising out of or related to the Service will not exceed the amount you paid to Fesera in the twelve (12) months preceding the claim, or NGN 5,000, whichever is greater.

Nothing in these Terms limits Fesera's liability for death or personal injury caused by its own gross negligence or fraud.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fesera and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service in a manner not authorised herein; (c) your provision of false or inaccurate information; or (d) your infringement of any third-party rights.

16. Termination

16.1 Termination by You

You may delete your account at any time from within the app settings or by contacting support@fesera.com. Deletion of your account will result in the permanent removal of your data as described in the Privacy Policy. Account deletion does not entitle you to a refund of any payments made.

16.2 Termination by Fesera

Fesera reserves the right to suspend or permanently terminate your account, with or without notice, if you breach these Terms, engage in conduct that harms the platform, or if required by law.

16.3 Effect of Termination

Upon termination, your right to access and use the Service ceases immediately. Sections 3, 9, 13, 14, 15, and 18 shall survive termination.

17. Modifications to These Terms

Fesera reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document and, for material changes, notify users via email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Fesera is incorporated and operates under Nigerian law, and Nigerian law governs the core contractual relationship between you and Fesera regardless of where you access the Service from.

18.2 Mandatory Local Consumer Rights

Nothing in these Terms removes or limits any rights you have under the mandatory consumer protection or data protection laws of your country of residence that cannot legally be excluded by contract. In particular:

  • EU users retain all rights under EU consumer protection directives, including the 14-day withdrawal right for digital content.
  • UK users retain equivalent rights under the UK Consumer Rights Act 2015.
  • Other jurisdictions — Fesera will honour the minimum mandatory consumer protections of your country of residence.

18.3 Informal Resolution

Before initiating formal proceedings, you agree to first contact Fesera at legal@fesera.com and attempt to resolve any dispute informally. We will make a genuine effort to resolve the issue within 30 days.

18.4 Jurisdiction

If informal resolution fails, and subject to any mandatory local rights, you agree that any legal action may be brought in the courts of Nigeria. Where mandatory local law requires disputes to be resolved in your local jurisdiction, that requirement takes precedence.

19. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by Fesera, constitute the entire agreement between you and Fesera regarding the Service.

Severability: If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions continue in full force.

Waiver: Fesera's failure to enforce any provision does not constitute a waiver of its right to enforce that provision in the future.

Assignment: You may not assign your rights without Fesera's prior written consent. Fesera may assign its rights freely.

These Terms were drafted with reference to Nigerian law, including the Federal Competition and Consumer Protection Act (FCCPA) 2018, the Nigeria Data Protection Act (NDPA) 2023, and general principles of contract law applicable in Nigeria; and with awareness of international consumer protection frameworks including the EU Consumer Rights Directive 2011/83/EU, the UK Consumer Rights Act 2015, and the OECD Guidelines for Consumer Protection in E-Commerce.
